1. Introduction and About Us
1.1 Job finder (“the Site”) is owned and operated Global Radio Media a company registered in England and Wales under number 923454 with its registered office at 30 Leicester Square, London WC2H 7LA ("Global Radio"). Our VAT number is 491 6907 13.
1.2 The Site is a recruitment and employment information service, which allows recruiters to place advertisements for available positions and receive responses from candidates, for recruiters to view CVs of potential candidates, and for candidates to upload CV’s and photographs, create networks, join forums and post content (“User Generated Content”).
2. Access to the Site
2.1 Access to the Site is permitted on a temporary basis and Global Radio reserves the right to withdraw the Site (in whole or in part) or amend any part (including but not limited to content and materials on the Site and any services made available through them).
2.2 Recruiters who wish to use the Site are required to set up and account (“Recruitment Account”). To set up a Recruitment Account please complete required details here or email our the LBC sales team at sales@jobs.LBC.co.uk. Global Radio reserves the right to refuse an application for a Recruitment Account at its sole discretion.
2.3 Global Radio shall not be liable if for any reason the Site is unavailable at any time or for any period.
3. User restrictions
3.1 Both recruiters and users of the Site must not:-
(i) modify or attempt to modify all or any part of the Site (other than material submitted by you);
(ii) gain or attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site;
(iii) use the Site to solicit candidates when you do not have a job vacancy that you are actively seeking to fill;
(iv) use the Site to compile a database of potential candidates that you or any third party may exploit for any commercial purpose (whether or not for profit), save that this clause will not prohibit you from compiling a list of potential employees for the job vacancy you are advertising from those who have responded to you or those job seekers who have uploaded their CV;
(v) use the Site in any way that breaches any applicable local, national or international law or regulation;
(vi) use the Site in any way that is unlawful, misrepresentative or fraudulent, or has any unlawful or fraudulent purpose or effect or promotes such purposes;
(vii) use the Site for the purpose of harming or attempting to harm minors in any way;
(viii) transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation.
3.2 You are responsible for making any arrangements necessary for you to have access to the Site. You are also responsible for ensuring that any persons who access the Site through your internet connection are aware of these Terms and comply with them.
3.3 Recruiters are solely responsible for verifying the information contained in responses to adverts or in CV’s that are uploaded to the Site or otherwise displayed Site including but not limited to, verifying the identity of respondents or candidates, their eligibility to work, training, qualifications and any applicable authorisations required by law or any professional body.
4. Use of Content
4.1 All content and material on the Site (but for the avoidance of doubt excluding User Generated Content) (the "Content") belongs to Global Radio, or its licensors, and save where otherwise specified users should assume that all Content is owned by Global Radio. The Content is protected by copyright laws around the world. Unless expressly stated, no Content may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way, and may only be used for your personal, non-commercial use. Modification of the Content or other prohibited use of the Content is a violation of Global Radio's copyright and other proprietary rights. All trademarks, service marks and trade names on the Site are proprietary to Global Radio or its licensors.
4.2 In particular, but without limiting the above restrictions, you may not do any of the following without prior written permission from Global Radio:-
(i) redistribute any of the Content (including by using it as part of any library, archive or similar service);
(ii) remove any copyright or trade mark notice from the Content; or
(iii) create a database in electronic or structured manual form by downloading and storing all or any of the Content.
4.3 You may not create any link from or to the Site without Global Radio's prior written consent.
5. User registration
5.1 On registration, you must provide Global Radio with accurate, complete registration information and it is your responsibility to inform Global Radio of any changes to that information. Each registration is for a single user only. On registration, you should choose a user name and password (collectively, "ID"). You should treat your ID as confidential. You warrant that you will not impersonate another individual when using the Site or the Site Services.
5.2 Global Radio does not permit any of the following:-
(i) any other person sharing your ID; or
(ii) access through a single ID being made available to multiple users on a network.
5.3 You are responsible for, and will be liable to Global Radio for, all use of the Site made by you or anyone else using your ID and for preventing unauthorised use of your ID. If you believe there has been any breach of security (e.g. the disclosure, theft or unauthorised use of your ID), you must notify Global Radio immediately at help@jobs.LBC.co.uk. Global Radio will not be liable to you or any third party for unauthorised use of your ID.
6. User Generated Content
6.1 By posting User Generated Content you warrant and agree that:-
(i) you are resident in Great Britain and that you are accessing the Site in Great Britain;
(ii) you own or are licensed in respect of the User Generated Content posted and that you have the right, power and authority to grant the rights set out in these Terms;
(iii) Global Radio is free and able to use User Generated Content in accordance with and in the manner set out in these Terms without any payment (including any royalty payments to third parties) and that in particular Global Radio may lawfully permit other users to view the User Generated Content;
(iv) you have obtained all consents, releases and permissions (including of each person identifiable) in respect of the User Generated Content.
6.2 and in addition you warrant and agree that such User Generated Content:
(v) is accurate (where facts are stated) or if an opinion is stated that such opinion is genuinely held;
(vi) is not confidential and does not infringe the intellectual property, privacy or any other rights of any third party, and does not contain anything which is unlawful, abusive, libellous, defamatory, obscene, indecent, harassing or threatening;
(vii) is not copyrighted or alternatively that you own the copyright or have the necessary permissions and rights to use it;
(viii) is not discriminatory or does not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
(ix) is not sexually explicit, obscene or pornographic and does not promote violence;
(x) such User Generated Content does not solicit personal information for any users under 18 years of age;
(xi) does not violate any applicable law or regulation;
(xii) does not, to the best of your knowledge, contain a virus or other harmful component or computer programming routines, software, files or code designed to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information;
(xiii) does not interrupt, destroy or limit the functionality of the Site or any computer software or equipment;
(xiv) does not disguise the origin of any User Generated Content or impersonate any person or entity or misrepresent any affiliation with any person or entity or collect or store other users' personal data;
(xv) does not, or is not likely to, harass, upset, embarrass, alarm or annoy another person; and
(xvi) does not give the impression that it emanates from a third party (including Global Radio) if that is not the case.
6.3 Global Radio reserves the right to remove, at any time and without reason or prior notice or any liability to you, any material that you have submitted to the Site.
7. Recruitment Accounts
7.1 In order to hold a Recruitment Account and to use the Site, recruiters must complete the Recruiter Registration Form and agree to full T&Cs. You will receive a confirmation email which you need to respond to for your account to activated. Global Radio reserves the right to recharge you for any charges we incur resulting from your chosen method of payment. Without prejudice to any of its other rights and remedies, interest will be charged on Charges that are not paid by the due date at the rate of 4% above the base rate of the Bank of England accruing from day to day.
7.2 If you are registered for VAT in a member state of the European Union other than the United Kingdom and wish to be invoiced with VAT charged at a rate of zero or such other rate as may be lower than the standard rate of VAT for the time being in force in the United Kingdom, you must provide us with your VAT registration number.
7.3 All charges are published on official Job Site Rate Card.
7.4 Global Radio reserves the right to change the Charges at any time. Any job postings and client campaigns active at time or Charge changes will not be affected. New charges will be published on Job Site Rate Card. Global Radio are not responsible for contacting Recruitment Account Holders when such changes are made.
8. Termination and suspension of users and Recruitment Accounts
8.1 Without prejudice to our other rights and remedies, at any time, for any reason and without giving you any advance notice, Global Radio may permanently or temporarily:
(i) terminate, suspend or deny your access to the Site;
(ii) cancel, terminate, suspend or deny your access to your Recruitment Account;
(iii) remove or edit any Content or User Generated Content on the Site at any time.
8.2 In such circumstances all liability of Global Radio, its directors, employees or other representatives for any loss whatsoever arising from our removing or editing Content and User Generated Content and/or your limited use of or inability to use the Site (either in whole or in part), your Recruitment Account and/or your ID is excluded, insofar as it is possible to do so in law.
8.3 You may cancel your Recruitment Account at any time with immediate effect by contacting your LBC account manager or online through your Recruitment account page. immediately on written notice to us at the end of the first three calendar months of registration (such notice to be provided to us before the end of the first three months). Thereafter you may cancel your Recruitment Account by giving us one month’s prior written notice.
8.4 If you cancel your Recruitment Account you will remain liable for all Charges payable up until the date that any such cancellation takes effect.
8.5 The cancellation of your Recruitment Account does not and will not affect the accrued rights and liabilities of Global Radio or the enforceability of the Terms that are intended to remain in force after cancellation.
9. Limitation of Liability
9.1 The Content is for your general information and use only and is not intended to address your particular requirements. Whilst Global Radio aims to update the Site regularly, any of the Content may be out of date and Global Radio assumes no responsibility for updating this. In particular, the Content does not constitute any form of advice, recommendation or arrangement by Global Radio and is not intended to be relied upon by users in making (or refraining from making) any specific decisions. Global Radio therefore disclaims all liability and responsibility arising from: (i) any reliance placed on Content or User Generated Content by any visitor to the Site or by anyone who may be informed of such; and (ii) any arrangements made between you and any third party named on the Site which are at your sole risk and responsibility.
9.2 Because of the number of sources from which Global Radio obtains Content and the nature of electronic distribution via the internet, Global Radio does not give any warranties in respect of the Site or the Site Services. In particular, the Site Services are provided on an "as is" basis. To the extent allowed by applicable law, Global Radio hereby disclaims all warranties, conditions or duties of every nature whatsoever (except any duties of good faith), including without limitation, any implied warranties of merchantability of fitness for a particular purpose, any express or statutory warranties, and any warranties or duties regarding accuracy or timeliness. In addition, Global Radio makes no warranty that the Site Services are free from infection by viruses or anything else that has contaminating or destructive properties.
9.3 To the fullest extent allowed by applicable law, you agree that Global Radio will not be liable to you and/or any third party for (i) any consequential or incidental damages; (ii) loss of business; (iii) loss of income or revenue; (iv) lost profits or contracts; (v) loss of data; (vi) loss of privacy; (vii) loss of goodwill; (viii) failure to meet any duty including but not limited to any duty of good faith; or (vi) for any indirect, special, or punitive damages whatsoever that arise out of or in connection with the use of the Site or the Site Services or any breach of these Terms by Global Radio, even if Global Radio has been advised of the possibility of such damages. Notwithstanding the provisions of this section, Global Radio's liabilities will not be limited in the case of death or personal injury directly caused by Global Radio's negligence, for fraud or fraudulent misrepresentation or for any liability that cannot be excluded or limited by law.
9.4 Global Radio is only responsible for the operation of the Site, subject to the limitations set out in these Terms. We do not guarantee that you will receive any responses to adverts placed for positions of employment, responses to your CV, or otherwise.
9.5 Global Radio is not responsible or in control of the acceptance of any applications made through the Site and does not offer an guarantee of employment through use of the Site.
9.6 Global Radio is not responsible and offers no liability for the actions of Site users in regards to applications made via the Site and for subsequent actions by candidates during interview phase and beyond.
9.6 You are solely responsible for all connection and equipment charges necessary to access and use the Site, as well as any other costs which you may incur as a result of or pursuant to your use of the Site.
10. Indemnity
You will indemnify and will keep indemnified Global Radio and its data providers and affiliates on demand against all claims, costs, proceedings, demands, losses, damages, expenses (including legal expenses) or liability whatsoever arising directly or indirectly as a result of:
(i) any breach of these Terms by you; or
(ii) your access to and/or use of the Site; or
(iii) your fault, negligence or breach of statutory duty.
11. Privacy Policy
This information that you provide about yourself to Global Radio will only be used by Global Radio in accordance with our Privacy Policy (details of which are available here: privacy policy.
12. Changes to these Terms
Global Radio reserves the right, at its discretion, to make changes to any part of the Site or these Terms. When these Terms are changed, Global Radio will publish details of the new Terms as updated from time to time. You are therefore advised to review these Terms regularly to ensure that you are aware of any changes we make. By continuing to use the Site, you are agreeing now to be bound by those changes and revised terms.
13. Advertising and sponsorship
Part of the Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Site complies with applicable laws and regulations. Global Radio will not be responsible for any error or inaccuracy in advertising material.
14. Choice of law & jurisdiction
These Terms shall be governed by, and construed in accordance with, English Law. You irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms or the legal relationship established by them, and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts. For the exclusive benefit of Global Radio, Global Radio retains the right to bring proceedings as to the substance of the matter in the courts of the country of your residence or, where these terms are entered into the course of your trade or profession, the country of your principal place of business.
15. Third Party Copyright
Some of the content used on our website(s) (such as, but not limited to, images and/or audio-visual material) are copyrighted works which belong to and are supplied by third parties (including but not limited to Getty Images, the BBC and ITN), who reserve all their rights in such content. All such third parties shall be entitled to enter the benefit of these Terms in respect of their content as if they were "Global Radio" herein and shall be bound accordingly.
16. General
You may not assign, sub-license or otherwise transfer any of the rights under these Terms. If any term is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. Failure by either party to exercise any right or remedy under these Terms does not constitute a waiver of that right or remedy. Headings in these terms are for convenience only and will have no legal meaning or effect.
